I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to all contracts concluded with us via the website Originanime.com, unless otherwise expressly agreed. Any inclusion of your own terms and conditions is hereby objected to, unless otherwise agreed.
(2) A consumer for the purposes of the following regulations is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of its self-employed professional or commercial activity.
§ 2 Conclusion of Contract
(1) The subject of the contract is the sale of goods. Our offers on the internet are non-binding and do not constitute a binding offer to conclude a contract.
(2) You can submit a binding purchase offer (order) via the online shopping cart system. The goods intended for purchase are placed in the "Shopping Cart". You can access the "Shopping Cart" at any time via the corresponding button in the navigation bar and make changes there. After accessing the "Checkout" page (or similar buttons such as "Proceed to Checkout" or "Continue to Purchase") and entering your personal data as well as payment and shipping conditions, the order data is displayed as an order summary. Before submitting the order, you have the option to check the details, change them (also via the internet browser's "Back" function), or cancel the purchase. By submitting the order via the corresponding button ("Order with obligation to pay", "Buy", "Buy now" or similar labels), you legally bindingly declare your acceptance of the offer, whereby the contract is concluded. You will first receive an automatic email regarding the receipt of your order, which does not yet lead to the conclusion of the contract.
(3) The acceptance of your offer (and thus the conclusion of the contract) occurs within 2 days through confirmation in text form (e.g., email), in which you are confirmed the execution of the order or delivery of the goods (order confirmation). If you have not received a corresponding message within this period, you are no longer bound by your order. Any services already rendered will be refunded immediately in this case.
(4) Order processing and the transmission of all information required in connection with the conclusion of the contract are partially automated via email. You must therefore ensure that the email address you have provided to us is correct, that the receipt of emails is technically guaranteed, and in particular that it is not prevented by SPAM filters.
§ 3 Right of Retention, Retention of Title
(1) You can only exercise a right of retention if it concerns claims arising from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
§ 4 Liability for Defects (Warranty)
(1) The statutory rights of liability for defects apply.
(2) As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage, and to notify us and the carrier of any complaints as soon as possible. Failure to do so has no effect on your statutory warranty claims.
(3) Insofar as a feature of the goods deviates from the objective requirements, the deviation is only deemed agreed if you were informed about this deviation before submitting the contractual declaration and the deviation was agreed expressly and separately between the contracting parties.
§ 5 Choice of Law
(1) German law applies. For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn (favourability principle).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) expressly do not apply.
